SEC v. David M. Colburn, et al., (the "Colburn Fair Fund")

As of October 4, 2012, we commenced mailing the SEC v. David M. Colburn, et al., (the “Colburn Fair Fund”), Case No. 1:08-cv-04611-LAP (S.D.N.Y.). This distribution has been calculated in accordance with the Court-approved Plan of Allocation. Please note, in order to be eligible to receive a distribution claimants must meet the distribution de minimis check amount of $10.

If you have received a check and are unable to negotiate due to beneficiary changes please e-mail your check reissue request to classact@gilardi.com and provide your Claim Number, Check Amount, Phone Number, and Current Mailing address. Please note, in order to change the named beneficiary on the check you must provide appropriate documentation, which when applicable, may include but is not limited to a death certificate, trust agreement, will, and or power of attorney.

The AOL Time Warner Securities Litigation Settlement

As of March 29th, 2012, we commenced mailing the second residual distribution of the Net Settlement Fund and the DOJ Funds in the AOL Time Warner, Inc. Securities and "ERISA" Litigation. Checks were mailed to those claimants with timely submitted claims and have cashed their previous residual distribution check. Please note, in order to be eligible to receive a residual distribution of unclaimed funds, claimants must meet the residual distribution de minimis check amount of $10.

This second distribution has been calculated in accordance with the Court-approved Plan of Allocation.

Please be advised that over 750,000 Proof of Claim forms were filed with total Recognized Claims exceeding $39 billion. The amount available for the second distribution of the Net Settlement Fund and DOJ Funds is approximately $22.6 million.
